Furthermore, USCIS will look into the funds themselves, in order to ensure that the money has been lawfully obtained from legitimate sources. Job creation is essential to obtaining an EB-5 visa, as it requires that in the span of a two year period, the invested company must create or retain 10 full time jobs for US workers. After proving that requirements of an EB-5 visa have been met within the 2 year conditional residency, the investor and their immediate family (spouse and unmarried children under the age of 21) become permanent residents of the US and are issued green cards.
